These terms and conditions (the “Terms and Conditions”) govern the use of https://bhebylon.store (the “Site”). This is owned and operated by Bhebylon.store Ltd ( Bhebylon.store ). This Site is an e-commerce website. 

The term “Vendor” is applied to the client who purchases services on https://bhebylon.store and  who has signed the GENERAL SERVICE AGREEMENT with the Contractor Bhebylon.store Ltd.

The term “Customer” is applied to the person who purchases goods on https://bhebylon.store.

The term “user / users” is applied to both the “Vendor” and the “Customer”.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

INTELLECTUAL PROPERTY

All content published and made available on our Site is the property of Bhebylon.store and the Site’s creators. This includes, but is not limited to images, texts, logos, documents, downloadable files and anything that contributes to the composition of our Site.

AGE RESTRICTION

The minimum age to use our Site is 18 years old. By using this Site, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

ACCEPTABLE USE

As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

• Harass or mistreat other users of our Site;
• Violate the rights of the other users of our Site;
• Contact users by using their personal information without their consent;
• Violate the intellectual property rights of the Site owners or any third party to the Site;

• List goods and upload photos of goods that do not exist;
• Modify, reject or cancel orders placed by users; and
• Exaggerate prices of goods.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

ACCOUNTS

When you create an account on our Site, you agree to the following:

• You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
• All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

SALE OF SERVICES

These Terms and Conditions govern the sale of services available on our Site.

The following services are available on our Site:

Membership Subscription

• Membership subscriptions for the online showcasing and sale of products that have been lawfully purchased or produced by the Vendor; and
• Delivery of products from Vendor’s shop address to billing / shipping addresses on orders.

The services will be paid for on a monthly basis starting from when the services are ordered.

Product photography services

We offer product photography services on our Site. This product photography service can be bought by Vendors to enhance the online display of products for a nice way of showcasing. We offer our expertise to shoot products in the best possible light.

This service can be bought by Vendors as and when required. We do not assert that our product photography is the highest quality that a professional photographer can achieve.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all the services we provide. You agree to purchase services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. 

MEMBERSHIP SUBSCRIPTIONS

When you purchase a membership subscription on our Site, your membership subscription does not renew automatically. You are required to complete the monthly payment on or before the due date to avoid interruption of your membership subscription.

Three (3) days before your next monthly payment is due, you will be notified with a reminder on your vendor dashboard or an invoice through email. You have the facility to complete your payment directly from the vendor dashboard by choosing the membership subscription you initially bought. You must authorise payment through checkout on the Site.

You are required to check your vendor dashboard or email for the due date and complete the payment for renewal of your membership subscription. Bhebylon.store will not be responsible for any negligence on your part for not checking updates and not verifying due date for membership subscription renewal.

Any failure to complete a payment on or before the due date, will automatically result in the temporary cessation of your activity on our Site. Once payment is completed, you will be able to continue using the services.

To cancel your membership subscription, please follow these steps:

• Visit your store dashboard and cancel your membership subscription from there.

When your membership subscription is cancelled, your account details and products are immediately deleted from the system.

After any cancellation of your membership subscription, if you purchase services on our Site again, a setup fee of Rs 1000 will be applied in addition to the price of the services purchased.

MEMBERSHIP SUBSCRIPTION UPGRADE

Vendors have the option to upgrade to another membership subscription option depending on the number of products they want to display on the Site. The date, on which the upgrade is purchased, will be retained for the monthly billing of the membership subscription renewal and the new prices will be applied.

You are required to check your email and check the due date for the payment for the renewal of your new membership subscription. Bhebylon.store will not be responsible for any negligence on your part for not checking updates and due date for the new membership subscription renewal.

CHANGE IN MEMBERSHIP SUBSCRIPTION PRICES

The membership subscription prices are subject to change. These prices will be reviewed from time to time. You will be notified by email or on your vendor dashboard about changes in these subscription prices. You are required to check your email or vendor dashboard about the amount you are paying for the membership subscription. Bhebylon.store will not be responsible for any negligence on your part for not checking updates concerning subscription prices.

SALE OF GOODS

These Terms and Conditions govern the sale of goods available on our Site. The following goods are available on our Site but are not limited to:

• Clothes
• Accessories
• Shoes
• Bags
• Beauty products
• Home care products

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock and on sale. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all the goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

THIRD PARTY GOODS

Our Site allows Vendors to sell goods. We do not assume any responsibility for the goods Vendors sell on our Site. We cannot guarantee the quality or accuracy of goods sold by Vendors on our Site. However, if we are made aware that a Vendor is violating these Terms and Conditions, we reserve the right to suspend or prohibit the Vendor from selling goods and services on our Site. The Vendor will not be granted access to the Site thereafter. The Vendor account and the products listed will be deleted from the system subject to the gravity of the matter reported. Upon the resolution of the matter the Vendor can be granted access to the Site.

We reserve the right to allow or deny all access to our Site.

PAYMENT METHODS

We accept the following payment methods on our Site:

• Credit Card;
• Direct Debit; and
• Payment through mobile phone (e.g. MCB Juice)

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

PAYMENT

The payment for the vendor goods sold on our Site, will be effected when the goods have been delivered to the billing / shipping addresses on the orders and the orders marked completed. 

Payment will be done through banks or through mobile banking (e.g MCB Juice ). All transactions can be viewed on the Vendor account. 

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to pay for the amount pertaining to the orders completed on our Site. This amount will be sent after deducting the agreed percentage profit in favour of Bhebylon.store.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

SHIPPING AND DELIVERY

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

• Standard delivery by post. Delivery takes 5 – 10 business days.
• Delivery by Bhebylon.store. Delivery takes 5 – 10 business days.

Delivery will take place as soon as reasonably possible, depending on the delivery method. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

EXCHANGE

Exchange of Services

We do not provide exchange of Services sold on our Site. 

Exchange of Goods

We provide exchange of goods sold on our Site.

To be eligible for an exchange, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

The Vendor shop where the goods are bought must be notified about the need for exchange and the exchange must be made within 14 days after receipt of your goods. Customers must go to the Vendor’s shop physical address for the exchange.

Bhebylon.store will not be held responsible for these exchange. These exchange will happen only at the discretion of both the Vendor and the Customer. Proofs of sold items need to be provided.

Vendors accept exchange requests for goods sold on our Site for any of the following reasons:

• Good is broken;
• Good is defective;
• Good does not match description; 
• Good is the wrong size from the one ordered; or
• Good does not fit on the Client and a smaller or bigger size is required.

Exchange do not apply to the following goods:

• Sale items;
• Food;
• Flowers;
• Newspaper or magazine;
• Intimate or sanitary goods;
• Hazardous materials;
• Flammable liquids or gases;
• Perfumes;
• Downloadable software products;
• Health and personal care items; 
• Underwear; and
• Make up.

Late exchanges will not be considered.

CONSUMER PROTECTION LAW

Where any customer protection legislation in our jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY

The services, all information, content, materials, products (including software), delivery services and all other services provided by Bhebylon.store are made available to you on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied. Bhebylon.store does not guarantee that the services will be error-free, uninterrupted, or free from harmful components, such as viruses. While we strive to ensure the services and products are accurate and up-to-date, we do not make any representations regarding their availability, functionality, or reliability, and you use them at your own risk.

To the fullest extent permitted by law, Bhebylon.store disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services, all information, content, materials, products (including software), delivery services and all other services included on or otherwise made available to you through Bhebylon.store will meet your requirements or expectations.

In no event will Bhebylon.store, its affiliates, partners, employees, directors, suppliers or agents be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the services, the use of this website, the purchase of products, the use of delivery services or any content or materials included or otherwise made available to you through the services. This includes, but is not limited to, any damages arising from the loss of profits, data, business opportunities, or from your inability to use or access the services.

While we strive to ensure that deliveries are made on time, we do not guarantee delivery dates or times. Any estimated delivery dates provided are for informational purposes only and may be subject to change. We are not liable for any damages, delays or losses caused by factors beyond our reasonable control including but not limited to third-party delays, weather conditions, customs issues, accidents, delivery failures or unforeseen circumstances. Our maximum liability to you for any claim arising out of your use of the website or our services shall not exceed the total amount you paid for the product(s) or service(s) in question.

INDEMNITY

These Terms and Conditions are governed by the laws of the Republic of Mauritius.

All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
